Terms and Conditions
1. ORDERS

When you submit an order to us, you are making an offer to us to purchase the products set out in your order on these terms and conditions only.

Our terms and conditions may change from time to time without notice. Changes will apply to orders received after this time.

All products are subject to availability. We try to ensure that products shown on the website are available for immediate delivery. You can normally expect your order to be dispatched within 3 to 5 working days. In the event that we are unable to supply the goods, we will inform you of this as soon as possible and refund any money paid.

We also try to ensure that all prices shown on the website are accurate. However, errors may occur. If we discover an error in the price of the goods you have ordered we will inform you as soon as possible and give you the option of reconfirming the order at the correct price or cancelling the order. If we are unable to contact you we will treat the order as cancelled. If you have paid for the order but decide to cancel, your money will be refunded, unless the goods have been specially ordered by us on your behalf from a third party.

We will acknowledge receipt of your order by email. Please check the acknowledgement carefully. If the order details are incorrect or you have changed your mind please e-mail sales@symingtons.co.uk immediately. Please note that receipt of the order acknowledgement does not imply or constitute acceptance of your order. Acceptance of your order and the formation of the contract between you and us will occur when we dispatch to you the products ordered. We will notify you if there is any delay or there are any problems with the order. We may decline an order for any reason at our sole discretion. 2. DELIVERY AND DISPATCH


We will e-mail you when your order is dispatched. No money will be taken from your payment card until dispatch of your order is imminent.

Orders are sent by Royal Mail and should reach you within 2-3 working days.

Your order will be sent to you as soon as reasonably possible and will normally be within 3-5 working days from receipt of your original order.

Should there be any unforeseeable delays you will be kept informed of a revised time of delivery.

If you have any problems with delivery please refer to DELIVERY PROBLEMS.

3. PAYMENT

No payment will be taken from your card until just before dispatch of your order. Prices quoted are inclusive of VAT @ 17.5%. A standard charge to cover postage and packing is payable in addition to the price of the goods shown on this website. One single charge is payable per order placed, regardless of the number of items included in the order.

Selling prices are valid only at the time shown on this website and may change after you submit your order.

You confirm that the credit/debit card that is being used is yours. The information provided by you is subjected to validation checks and every card transaction is submitted for authorization to the card issuer and we may share your personal information with such third parties as are necessary to enable us to carry out such checks. If the issuer of your payment card declines to authorize payment to us, we will not be liable for any delay or non-delivery.

4. OWNERSHIP AND RISK

You will become the owner of the products ordered once they have been paid for in full and delivered to you. The risk of loss of or damage to these products becomes yours once they have been delivered to you.

5. DESCRIPTION AND QUALITY

The descriptions of the products you order are as shown on our website at the time you submit your order.

We will not be liable to you for any defects in products arising from fair wear and tear, wilful damage, accident, negligence by you or any third party, or from any
failure by you to follow our recommendations for wearing, maintaining or cleaning of the goods or for any repairs carried out to them without our approval.

Nothing in these terms and conditions affects any statutory rights you have as a consumer.

6. OUR RETURNS POLICY

We are sure that you will be very happy with your purchase. However, we will act promptly if the goods we send you are damaged, defective or incorrect. We also offer a 14 day 'no quibble' cancellation service with a money back guarantee. Please see below for the details of both these services.

Please adhere to the following instructions when returning goods -

(a) If the item was damaged in transit

If you take delivery of a package and the contents have been damaged in transit, you can return the item(s) to us within 14 days of receipt for exchange. Please contact us by e-mail (sales@symingtons.co.uk) as soon as possible to inform us of your wish to return your goods, and we will allocate you a return code, which you must include in the package to ensure we process your return as efficiently as possible. You must also include your original order number, with your name and address. We will arrange for a replacement to be sent and refund the postage cost of returning the item to us.

(b) If the item is defective

You have the right to return a faulty item within a reasonable period of time. Please contact us by e-mail (sales@symingtons.co.uk) as soon as possible to inform us of your wish to return your goods, and we will allocate you a return code, which you must include in the package to ensure we process your return as efficiently as possible. You must also include your original order number, with your name and address. We will arrange for a replacement to be sent and refund the postage cost of returning the item to us.

(c) If we sent you an item you did not order (an "incorrect" item)

As soon as you find out we've sent you an incorrect item please contact us by e-mail (sales@symingtons.co.uk) as soon as possible, to inform us of the details of the error. We will allocate you a return code, which you must include in the package to ensure we process your return as efficiently as possible. You must also include your original order number, with your name and address. We will arrange for the correct item to be sent and refund the postage cost of returning the item to us.

Note: in the event that we send you a replacement for a damaged, defective or incorrect item, you must return the original item to us within 30 days of our e-mail confirming the issue of the replacement item. Provided you return this item to us within the 30 days, you will have nothing more to pay. If you do not return the original item to us by the end of the 30 day period, we reserve the right to charge an amount equal to the price of your original order to the payment card you used for the order.

(d) Cancellations/no quibble returns

By law, customers have the right to withdraw from the purchase of an item within seven working days of the day after the date the item is delivered. We operate a 14 day no quibble money back guarantee

If within 14 days you are unhappy with the product you may return it to us. Any product returned must be unused and in perfect re-saleable condition for us to be able to refund any payment. Please note that, in the interests of hygiene, this return policy does not apply to earrings or other body products. Special order items are also excluded.

Please contact us by e-mail at sales@symingtons.co.uk (THE CANCELLATION RIGHT CAN ALSO BE EXERCISED BY POST OR BY TELEPHONE) to inform us of your wish to return your goods, and we will allocate you a return code, which you must include in the package to ensure we process your return as efficiently as possible. You must also include your original order number, with your name and address.

Wrap the package carefully and send it back to the returns address above. Where possible obtain a proof of posting certificate from the Post Office, as you are responsible for the package until we receive it returned safely into our warehouse.

It is your responsibility to meet the costs of returning the goods to us, and to take care that they are not damaged while in your care or in transit. If you do not return the goods as required, we may charge you a sum not exceeding the direct costs of recovering the goods. If we have not yet refunded you (see below) we may deduct these costs before refunding the balance to you. Any refund will be provided as soon as possible and at the latest within 30 days of our receiving the returned order. We will e-mail you to let you know that the returned item has been received.

7. SECURITY

At Symingtons we are committed to protecting your security and privacy.

The information you send us is protected by using Secure Socket Layer (SSL) technology (shown by the padlock in the bottom right hand corner of the screen). This shows that your information cannot be intercepted as it travels over the internet. Once your information reaches us it is stored behind firewalls to prevent unauthorised access.

We reveal only the last four digits of your credit card numbers when confirming an order. Of course, we transmit the entire credit card number to the appropriate credit card company during order processing.

We maintain physical, electronic and procedural safeguards in connection with the collection, storage and disclosure of personally identifiable customer information. Our security procedures mean that we may occasionally request proof of identity before we disclose personal information to you.

It is important for you to protect against unauthorized access to your password and to your computer. Be sure to sign off when you finish using a shared computer.

8. DELIVERY PROBLEMS

If you have received an email from us confirming receipt of your original order, then your order is in our system and is being dealt with.

Wherever possible, we try to ensure that you will take delivery of your order within 7 days (3 to 5 days for dispatch and 2 to 3 days in the postal system) from your receiving our initial email. In the unlikely event of delivery problems at our end we will keep you informed by e-mail of expected dispatch dates.

If you have received an email confirming that your order has been dispatched but you have not received it, please wait 7 days after the dispatch date before contacting us about a missing order at sales@symingtons.co.uk. During that time we recommend that you ask your local Royal Mail sorting office if they have already tried to deliver it and ask neighbours if the package has been left with them. You should also check that the delivery address is correct. Please contact us at sales@symingtons.co.uk for help in locating your missing order via the postal system.

Your use of this website and any sales contract arising therefrom shall be governed by Scottish Law and the Scottish Courts shall have non-exclusive jurisdiction over any claim or dispute that may arise in respect thereof.
